1. Who we are

The service is provided by BENNIX LIMITED (company number 17292413, registered in England and Wales; registered office: 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom) (“we”). Contact: contact@killerpool3d.com. “Service” means the Killer Pool 3D game (killerpool3d.com, iOS and Android apps) and its social features.

2. Eligibility and accounts

• You must be 18 years or older to use the service.
• You are responsible for the accuracy and security of your account details and for activity on your account.
• You may not sell, transfer, rent or share your account. One person may not cheat by using multiple accounts.
• Tell us immediately if you notice suspicious access.

3. Licence and acceptable use

We grant you a limited, non-transferable, non-exclusive, revocable licence to use the service for personal, non-commercial purposes. The following are prohibited:

• Cheating, bots/automation, exploiting bugs, reverse engineering, or trying to disrupt the service or other players
• Harassment, threats, hate speech, sexual or violent content and illegal content
• Asking for or sharing personal information (phone, address, passwords, etc.); impersonating others
• Scraping or collecting data with automated tools

4. Community, chat and reporting

Chat is only available between mutual friends and only in the lobby. Usernames and messages are automatically filtered for inappropriate content. You can report and block other players. We review reports and may enforce the rules by warning, temporarily or permanently restricting, or closing accounts. For serious violations we may act without warning. 5. Virtual items: coins, gems, skins

• Coins are earned only in the game; they are not sold, cannot be bought with gems or money, have no real-world value and cannot be cashed out.
• Gems and skins (cues, tables, balls, emotes) are virtual digital items usable only in the game: they cannot be transferred, gifted, traded between players, or exchanged for cash or coins. Skins are cosmetic only and do not affect gameplay power.
• You only obtain a limited right to use virtual items in the game; ownership stays with us.
• Table entries and prizes use in-game coins only. No real money can be won; the service is not a gambling service and contains no random paid rewards (loot boxes).

6. Purchases, payment and refunds

• Purchases are subject to the relevant platform’s terms: Apple or Google in the apps, Stripe on the web. Prices are shown tax-inclusive for your country and may change.
• Purchased items are tied to your account; if your account is closed or deleted (including at your own request), balances and items are lost.
• Refunds: for Apple/Google purchases refunds follow the platform’s rules; for web purchases you can write to us. Details: Support. Your statutory rights are unaffected.
• Digital content and withdrawal: digital content is delivered immediately after purchase. Where the law allows, and with your consent, your right to withdraw ends once delivery begins.
• For suspicious, fraudulent or charged-back transactions we may reverse the related items and restrict the account.

7. Events

Events (such as the monthly season) may change in theme, duration, rewards and price. Event tickets are bought with gems; rewards are in-game virtual items only and may be limited to the event period.

8. Platform terms

When you get the app through Apple or Google, that platform’s terms also apply. Apple and Google are not parties to these terms and are not responsible for the app’s maintenance, support or warranties; to the extent the law allows, Apple is a third-party beneficiary of these terms for the iOS app.

9. Intellectual property

The game, artwork, characters, sounds, music, software and trademarks belong to BENNIX LIMITED or its licensors. You may not copy, modify, distribute or create derivative works except for personal, non-commercial play. We may use feedback you send us free of charge.

10. Availability and changes

We keep improving the service; we may change features, prices and content and may suspend it temporarily for maintenance. If we end the service entirely we will announce it with reasonable notice.

11. Suspension and termination

You can delete your account in the app at any time (delete account). If you breach these terms we may restrict or close your account. On termination, remaining virtual items and balances are not refunded except where the law requires.

12. No warranty

The service is provided “as is” and “as available”; we do not guarantee it will be uninterrupted, error-free or work on every device. To the extent the law allows, implied warranties are excluded.

13. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential losses, or loss of data or profit; our total liability is limited to the amount you paid us for the service in the 12 months before the event. This does not affect our liability for death or personal injury, fraud or wilful misconduct and in other cases where the law does not permit limitation, nor your mandatory rights as a consumer.

14. Governing law and disputes

These terms are governed by the laws of England and Wales and the courts of England and Wales have jurisdiction. As a consumer you keep the mandatory consumer protection provisions of the country where you live and the right to go to your local courts. 15. Changes to these terms

We may update these terms; we announce important changes in the game or by email. Continuing to use the service after a change means you accept the new terms; if you don’t, you can delete your account.
